Non-solicitation
Client understands that company’s investment in its employees is substantial in the form of training, compensation, and the imputation of confidential business information and trade secrets. In consideration of company allowing its providers to provides services described herein at client’s request, client agrees not to solicit, hire, or otherwise induce company’s employees and or providers to perform services for client similar to the services company provides to Client under this agreement, unless arranged by and through company, for a period of six (36) months from the date services were last provided to Client. In the event Client violates this paragraph, client agrees to pay company liquidated damages in the amount of $5,000, which is not designed to penalize client, but to compensate company for the costs associated with lost business opportunity and having to assign another employee/contractor to provide services, or, in the event of the loss of its employee, having to hire and train a new employee
Breaches of these terms and conditions
Without prejudice to Red Bus Tours Jamaica’s other rights under these terms and conditions, if you breach these terms and conditions in any way, Red Bus Tours Jamaica may take such action as Red Bus Tours Jamaica deems appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and or bringing court proceedings against you.

Red Bus Tours Jamaica obligations and liabilities do not extend beyond that of a booking agency and therefore Red Bus Tours Jamaica shall not be held liable for any loss or damage/s that the Hirer may incur as a result of a mechanical breakdown while on charter. The Hirer acknowledges that Red Bus Tours Jamaica shall not be held liable for any mechanical breakdowns/disturbances of the Hire however should any mechanical breakdown occur prior or during the Hire including an accident or if the vehicle is no longer safe to drive, then the company shall endeavor, without guarantee to do so, make alternative arrangements to get the Hirer to their destination. Red Bus Tours Jamaica may use its discretion in order to determine the method of alternative travel arrangement or alternatively the Hirer may make their own alternative arrangements bearing their own costs. The Hirer agrees and acknowledges that a claim for costs relating to alternative arrangements made on their own behalf cannot and will not be made against Red Bus Tours Jamaica.
Red Bus Tours Jamaica accepts no responsibility and shall not be held liable for any damages, losses or costs incurred/suffered as a result of any delays caused by unsafe road conditions (i.e.. traffic, accidents, etc.) and delays caused by previous Bookings going overtime.
Red Bus Tours Jamaica shall not be held responsible or liable for the safe retention of articles left in any Vehicle by the Hirer or Party. The Hirer accepts responsibility and liability on behalf of the Hirer’s Party for any losses property belonging the Company and/or Affiliate/Owner Driver that is provided in a Vehicle which includes but is not limited to, glassware, CD’s, DVD’s, etc.
Vehicles cannot be loaded beyond legal seating capacity and the Driver and Company reserve the right to terminate the reservation should the Hirer insist to carry more passengers than the Vehicle is legally able. The conditions stipulated above applies.
It is a legal requirement that all passengers wear a seat belt where fitted whilst in the Vehicle. The Hirer agrees and specifically indemnify the Company and the Chauffeur against any fines imposed as a consequence of the passengers failing to comply with this legal requirement. Where the Hirer has asked for a child seat to be fitted, it is the responsibility of the Hirer to supply and ensure that the seat is correctly fitted before placing an infant into the seat.
The Hirer accepts and agrees, except in cases of an emergency, that the Chauffeur may only open and close doors of the Vehicle. Red Bus Tours Jamaica will not be held responsible for accidents and/or damages caused to Vehicle/s, persons and property as a consequence of the Hirer and/or the Party opening and closing doors.
Irresponsible behavior which could give rise to or damage the Vehicle or endanger the safety of the other passengers will not be tolerated at any time by the Chauffer or Company which includes negligent treatment of the Vehicle such as sitting on the exterior of the vehicle, hanging out of the windows, shouting abuse to other road users or pedestrians out of the window, rudeness or intolerance with the Chauffeur, misuse of the equipment, fixtures or consumable within the vehicle and willful damage to the interior generally and such behavior may, at the sole discretion of the Chauffeur, Red Bus Tours Jamaica or its employees result in the immediate termination of the Hire without compensation. In addition, the Hirer shall be held liable and responsible for any loss, howsoever caused, by the irresponsible behavior, actions or negligence of his or her Party.
The Hirer acknowledges that he/she indemnifies Red Bus Tours Jamaica and its employees against any loss, consequential or otherwise as a result, direct or indirect or otherwise of a failure to meet time deadlines. The Hirer accepts total responsibility to ensure that there is adequate time to travel to and from destinations required by the time deadline/s required. Any advice provided by Red Bus Tours Jamaica or its employees to the Hirer, is to be used only as a guide and the Hirer accepts this guide may be inaccurate due to unforeseen circumstances including, but not limited to, traffic conditions, poor weather, break downs and overtime, etc.
The Hirer accepts that in car entertainment such as television screens, video and DVD equipment is provided as a courtesy and its use and/or availability does not form part of the Hire. In the event that any equipment fitted to the Vehicle malfunctions or is not in working order prior to or during the Hire, Red Bus Tours Jamaica shall hold no liability whatsoever and shall not be liable for the payment of any compensation for such instances, nor will the Company be held liable for claims for any form of refund or cause of action.
Red Bus Tours Jamaica shall not be held liable for any claims, damages, compensation or loss that may arise as a result of the Hire of any nature whatsoever including any future claims that may arise as a result of a Hire.
Where the Hirer is a Business or a company and the forgoing has had a representative make the booking of its behalf, the Business or company shall assume the liability of the Hirer and the representative shall be deemed bound to advise the Hirer and party of the terms and conditions for the Hire.
The Hirer accepts and acknowledges that Red Bus Tours Jamaica will not be held liable for any damages or losses that may be suffered/incurred by the Hirer as a result of the Vehicle failing to attend or failing to comply with the terms of the Hire at the location, time and date scheduled.
Smoking Strictly Prohibited
Smoking in all vehicles is strictly prohibited. Smoking in the vehicle by the client or any passenger will result in an automatic minimum $300 charge. Damage caused by smoking activity will also be charged to the client.
Staff Accommodations
On occasions that require overnight travel for chauffeurs, onsite coordinators or other client-dedicated staff, lodging and meals should be arranged and provided for by the client.
Passenger Conduct
Red Bus Tours Jamaica reserves the right to refuse to transport persons under the influence of or in possession of illegal drugs, as well as those excessively intoxicated, in the possession of firearms or dangerous substances of any kind, or who are, or are likely to become objectionable to other persons or if the chauffeur feels threatened in any way. Under no circumstances are minors allowed to consume or possess alcohol or illegal substances while in a company vehicle. Client shall not interfere with the chauffeur in the discharge of his/her duty or tamper with any apparatus or appliance on the vehicle. In such instances, services will be terminated immediately and no refunds will be offered.
Excess Cleaning & Damage
Clean up fees may be charged when activity inside the vehicle leaves a residual odor or stains the carpet/upholstery, including but not limited to smoking, spilled food or drinks, foods with a heavy odor and vomit.Repair fees may be charges when physical damage is caused to the vehicle including but not limited to rips and tears to the carpet, upholstery, or other soft materials; damage to moldings, door panels or other components.If during or after the transportation service, the company is required to expend an extended amount of time and material to clean the vehicle due to acts of the client or any passenger that is spilling food & drinks, vomiting, prohibited smoking, excessive trash) the company, at its discretion, will charge client additional fees to cover such expense. Damage to the vehicle in any way caused by actions of the client or any passenger will be charged in full to the client. The Hirer agrees to accept full financial responsibility and unlimited liability for any damage caused to the Vehicle by the Hirer or any members of their/his/her Party. The Hirer shall accept full responsibility and liability to pay damages to the Company for the cost of repair of the damage, any loss of income on behalf of the Affiliate/Owner Driver and/or Company as a result of the damage plus a Sanitation fee of $250.00.
Force Majeure
Red Bus Tours Jamaica shall not be liable for any failure or delay in performing its obligations under the Service Contract, and shall not be deemed in breach of its obligations there-under, if such failure or delay is due to Acts of God, natural disasters, national or local states of emergency, acts of war or terrorism, labor strike or lock-out, or other industrial or transportation accident caused by any third party, any violation of law, regulation or ordinance by any third party or any other cause not within the control of the Company.
Amendments
Amendments or changes to your booking must be received from the lead named passenger and the email address we have on the booking at least 24 hours before delivery dates. Additional charges may be applicable, for which you will be advised at the time of the amendment.Please note that any incorrect information on the documentation received from us, must be brought to our attention within seven days of the date of issue of the received documents. We will not accept responsibility if you neglect to check the validity of all the information provided after the time period specified above.
Luggage
If you are carrying any excess luggage such as more than 2 bag per person, golf clubs, bicycles, strollers, but not limited to, or other over sized items, you will need to inform us when booking to ensure we can provide the correct vehicle.One suitcase/piece as defined by weighing no more than 50 lbs) and one carry on piece as defined by measuring not more than is 60 lb free.Clients with over sized luggage shall be transported via private service. In order to ensure clients safety, luggage must be placed in the areas reserved for this purpose; they cannot be transported aboard the vehicle on seats or in areas intended to enable people to move around inside the vehicle.Should you fail to notify us, you will be liable for any additional costs incurred.
Information
Red Bus Tours Jamaica is not responsible for wrong information such as incorrect flight info, dates, e-mail address or any information submitted by you. We will not make compensation payments for any cancellation/changes caused by any incorrect information supplied by you. Red Bus Tours Jamaica will put its’ best endeavors to find and rectify any errors and omission as quickly as possible. However, there may be times when obvious errors occur such as the price or some other detail displayed being incorrect. In this case Red Bus Tours Jamaica shall reserve the right to cancel that contract and the customer will not have any liability to this regard.
Last Minute Bookings
All reservations made within 24 hours of transfer/service must be communicated to our booking agents by calling 1-555-555-5555 and or via email to info@redbusja.com failure to comply may hinder our ability to fulfill our obligation due to technical issues or unforeseen circumstances which we cannot be held responsible for.In the event that the passengers fails to appear for the requested service, the clients will be charged the full cost including any additional charges that the booking would have incurred.
Animals
Animals are authorized aboard vehicles, provided that they are placed in cages designed for their transport and insofar as they do not represent any threat to the Carrier, the other travelers or to third parties. In the case of shared service, Red Bus Tours Jamaica reserves the right to refuse to transport a cage measuring more than 48/32/31 cm (length/width/height).
Special Request
Red Bus Tours Jamaica facilitate our clients by providing infant/child seats at an additional cost. At the time of booking it is the client’s responsibility to advise us of any special requests for a child seat for transfers. Please note however, these cannot be guaranteed. Where child seats are available, we will provide a maximum two car seats for infants up to three years old.Clients are expected to provide at the time of booking full details on any special requirements i.e. wheelchair access in order to satisfy the booking. Failure to provide full details may lead to additional charges being applied in order to fulfill the booking request.

You hereby represent, understand and expressly agree that Red Bus Tours Jamaica does not control the quality, timing, legality or any other aspect whatsoever of the services actually delivered by these third party owners, nor of the integrity, responsibility or any of the actions whatsoever of these companies.
Red Bus Tours Jamaica will use its best efforts to offer services provided by those companies who are reputable and offer quality services in accordance with the Jamaica Tourist Board. We have taken care and responsibility to verify and check all information provided on our website at the time of compilation; however as this information is supplied by the relevant attraction, tour, cruise operator, we accept no responsibility for any inaccuracy contained in the information provided on our website.
Deposits
A non-refundable deposit is required on all bookings made online or through our contact service center Payment can be made via Paypal or by cash to our agents. All deposits are non-refundable with the exception of poor weather or a cancellation on the part of Red Bus Tours Jamaica. In the event of that which may prevent tour/services, the full amount of deposit and any amount paid thereafter shall be returned to customer within fourteen business days.
Fees – No portion of transfer/tour fees are transferable or refundable once service commence.
Cancellation Policy
A cancellation fee as follows will be applicable on transportation and tour bookings.
Cancellation 7 days or more before: 25% cancellation fee applicable
Cancellation 72 hours before: 50% cancellation fee applicable
Cancellation 48 hours or less: 100% cancellation fee applicable
No show booking :100% fee is applicable . Any cancellation by you must be acknowledged by Red Bus Tours Jamaica.We do not accept verbal cancellation unless approved by Red Bus Tours Jamaica therefore please email your cancellation request to info@redbusja.com
Refund Policy
Clients shall receive a refund if cancellation terms and conditions are complied with. Deposits are non -refundable deposit with the exception of poor weather or a cancellation on the part of Red Bus Tours Jamaica. If customer fails to comply with cancellation terms, absolutely no refund shall be due. If you decide, for any reason whatsoever, not to participate in all or part of your scheduled transfer, Red Bus Tours Jamaica will not be required to make any refunds.There is absolutely no refund for no-shows and those who wish to cancel upon start of tour/transfer.
Additional Persons
You are not permitted to include additional persons on your transfers without the prior approval of Red Bus Tours Jamaica. Once booking is completed, any addition will attract an additional fee. In any case Red Bus Tours Jamaica are only liable to transport the number of persons booked for at the time of booking. Any addition will attract an additional fee and the appropriate fees will be applied at the time of amendment. Failure to make the required payment will result in only the transportation of the original persons booked.
Prepaid Transfers and Tours Reservations
By reserving your transportation and tours services, you authorize Red Bus Tours Jamaica to book reservations for the total reservation price. You agree that your credit card will be charged by Red Bus Tours Jamaica for the total reservation price.
Bank and Credit Card Fees
Some banks and credit cards impose fees for cross-border transactions. By reserving your tour and taxi on this website, you may see an additional cost/fee appearing on your credit card statement. This fee is solely determined by your Bank and/or Credit Card Company and Red Bus Tours Jamaica takes no responsibility for these associated costs. If you have any questions about these types of fees applied to your reservation, please contact your bank directly.
Acceptance of Risk
You acknowledges that tours offered on this website may be adventurous in nature and may involve a significant amount of personal risk.
